Terms of Service

These Terms of Service ("Terms") govern your access to and use of the F3 mobile application and website (getf3.com) (collectively, the "App"). By accessing or using F3, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

1. Acceptance of Terms

By downloading, accessing, or using F3, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Use License

F3 grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute the App without permission
• Reverse engineer, decompile, or attempt to derive the source code
• Use the App for any commercial purpose or in any way that competes with F3
• Remove or alter any copyright, trademark, or other proprietary notices
• Access the App through any automated means or bots

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and are liable for all activities that occur under your account. You agree to:

• Provide accurate and complete information when creating your account
• Promptly update your information if it changes
• Notify us immediately of any unauthorized access to your account
• Not share your account with other users

4. Acceptable Use

You agree not to use the App in any way that:

• Violates any applicable law, regulation, or these Terms
• Infringes on anyone's intellectual property rights
• Contains defamatory, obscene, or harmful content
• Harasses, threatens, intimidates, or abuses other users
• Transmits viruses, malware, or other harmful code
• Interferes with the App's functionality or security
• Impersonates any person or organization
• Circumvents any security measures or access controls

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines.

5. Intellectual Property Rights

F3, Focus Fight FINISH, and all related names, logos, and marks are trademarks owned by Jada Sullivan and F3. These trademarks are protected by applicable intellectual property laws and may not be used without express written permission.

You retain ownership of any content you create within the App (such as voice journals and personal notes). By using the App, you grant F3 a worldwide, royalty-free license to use, reproduce, and distribute this content to provide the App's services (including sharing with your accountability partners as you direct).

6. Disclaimer of Warranties

F3 is provided "as is" and "as available" without warranties of any kind, express or implied. F3 does not warrant that:

• The App will be uninterrupted, error-free, or secure
• Any defects will be corrected
• The App will meet your specific needs or expectations
• The App is free of viruses or other harmful code

F3 is not responsible for the accuracy, completeness, or usefulness of any information in the App. Your use of the App is entirely at your own risk.

7. Limitation of Liability

To the maximum extent permitted by law, F3, its founders, and their agents shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Loss of profits, data, revenue, or business opportunity
• Damages arising from your use of or inability to use the App
• Errors, omissions, or inaccuracies in the App
• Loss or damage to your device or data

Our total liability shall not exceed the amount you paid to use F3 (if any). Some jurisdictions do not allow limitation of liability, so this may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless F3 and its founders from any claims, damages, losses, or expenses arising from your violation of these Terms, your use of the App, or any content you create.

9. Termination

F3 may suspend or terminate your account and access to the App at any time, with or without cause, and without notice. You may terminate your account by deleting the App and contacting us to request account deletion. Upon termination, your right to use the App immediately ceases.

10. Third-Party Links and Services

The App may contain links to third-party websites and services. F3 does not endorse or assume responsibility for third-party content. Your use of third-party services is governed by their terms and policies. We are not liable for any issues arising from third-party links or services.

11. Health and Fitness Disclaimers

F3 is a tracking and accountability app, not medical advice. If you connect health or fitness data from Apple HealthKit or Whoop, you acknowledge that:

• F3 does not diagnose, treat, or cure any medical condition
• You should consult a healthcare provider before starting any new fitness or health regimen
• F3 is not a substitute for professional medical advice
• Your use of health data is at your own risk

12. Changes to the App

F3 reserves the right to modify, suspend, or discontinue the App or any features at any time, with or without notice. We may also update these Terms from time to time. Your continued use of the App constitutes acceptance of any modifications.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any dispute shall be resolved in the courts located in the jurisdiction where F3 is operated.

14. Dispute Resolution

Before pursuing legal action, you agree to attempt to resolve any dispute with F3 through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration, except for injunctive relief related to intellectual property infringement.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and F3 regarding your use of the App and supersede all prior agreements or understandings.
